In the recent case MAP v MFP EWHC 627 (Fam), the High Court considered whether the wife, in her application for financial remedy within divorce proceedings, was entitled to ‘add back’ assets which she alleged her husband had dissipated.
During the course of the marriage breakdown the wife was also dismissed from her employment within the husband’s company which she claimed had caused her great financial loss. The Court dismissed the wife’s claim for ‘add back’ but recognised the financial loss caused by the wife being dismissed from the company.
The wife was awarded £12.3m of the total assets of approximately £25m in full and final settlement of her claim
